Terms of Service
Domain Registration Services
Overview
You acknowledge and agree that we cannot guarantee that you will obtain a desired domain name you wish to order, even if an inquiry indicates that a domain name is available at the time of your application or upon payment for same. In order to enable us to quickly register any available domain, you have the option to pay us in advance, prior to your order. Having said that, even that will not guarantee successful registration of any domain name since someone else may have also ordered the same name and could have it registered just before we do it for you.
Payments for domain name order must be made in advance. In addition, payments for domain name renewal must be made 30 days prior to expiry in order to avoid suspension by eNom.com.
You represent that, to the best of the your knowledge and belief, neither the registration of the domain name nor the manner in which it is directly or indirectly to be used, infringes upon the legal rights of a third party and further, that the domain name is not being registered for nor shall it at any time whatsoever be used for any unlawful purpose.
As Technology Partners of eNom.com, who in turn, is accredited by ICANN, domains sold by us are registered and maintained by eNom.com and are governed by their Domain Names Term's and Conditions; on all matters relating to domain names (regsitration, transfer & renewal), with the exception of payment, which is to be made directly to us.
Hosting Services
Overview
WEB SOLutions is dedicated to providing an all-round top quality hosting service. The terms and conditions which follow are necessary to ensure that we may continue to provide the best possible service and support to all of our account holders whilst at the same time satisfying our legal and ethical responsibilities.
When account holders sign up with us, they are deemed to have read, understood and accept the following terms and conditions. Account holders also agree that failure to follow any term or condition will be grounds for immediate account deactivation without notice. WEB SOLutionS will be the sole arbiter as to what constitutes a violation of any of these provisions.
Activity which results in the suspension or deactivation of an account will result in a forfeiture of all fees paid. Complaints made regarding abuses of an account will be investigated and if found guilty will be grounds for immediate suspension.

Our Terms Of Service(TOS) can be summed up in three sentences:
- Don't use our service for anything illegal.
- Other people have equal right to use the shared resources on your server.
- The Internet is a powerful tool, and we give you full access to it, use it wisely.
Unfortunately, you have to look over our long version, since we cannot provide you with our hosting services unless you agree to these terms.
The following is an agreement that documents the terms of service for web hosting accounts between WEB SOLutionS and our account holders.
ACCEPTABLE USAGE POLICIES
Content & Storage Policy
- All account holders are responsible for their own account and visitors to their sites.
- Any use which interferes with the server's ability to function in its primary purpose of publishing web documents is prohibited.
- All services provided by WEB SOLutionS must be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any Malaysian/US law is prohibited. This includes, but is not limited to: copyrighted material, trademark, intellectual property, material we judge to be threatening or obscene, or material protected by trade secret and other statute without proper authorization.
- Specifically, pornography and sex-related merchandising is prohibited on all WEB SOLutionS servers. This includes sites that may infer sexual content, or links to adult content elsewhere.
- The following are also strictly prohibited:-
- Pirated software
- Hacker programs or archives
- Warez sites- Also prohibited are sites that promote any illegal activity or present content that may be damaging to WEB SOLutionS servers or any other server on the internet. Links to such materials are also prohibited.
- Use of WEB SOLutionS's facilities to commit network abuse (including, but not limited to, denial of service attacks such as ping bombing, email bombing, "smurf", "winnuke", "land", "teardrop", etc.) or otherwise compromise the security of hosts or networks is prohibited.
- If your files exceed the specified limits of the respective plans, upload or emails to your site will be locked and your site will no longer be able to receive new files or emails. You will have the option to upgrade to the next plan or re-negiotiate a new arrangement with us.
Email & SPAM Policy
- WEB SOLutionS is committed to a zero-tolerance, anti-Spamming policy. We prohibit Spam, or any unsolicited commercial email, from being sent either: Over the WEB SOLutionS network, by account holders or any other users of the WEB SOLutionS network (including account holders' customers); AND/OR over ANY network— if the message sent advertises or mentions a site hosted on the WEB SOLutionS server.
- WEB SOLutionS may not be the source, intermediary, or destination address involved in the transmission of any unsolicited email, email bombs, hate email, or any mass email. Account holders email account may not be referenced as originator, intermediary, or reply-to address of such email. We consider mass email any email message sent to more than 25 email addresses or more than 10 news groups.
- We react quickly and seriously to violations, and we further reserve the right to terminate the services, without prior notice, of any account holder disregarding this policy. Sending unsolicited commercial email (a.k.a. "spam"), cross-posting messages to a large number of Usenet groups, posting obscene or threatening messages while using or referring to an WEB SOLutionS email address or web site URL is prohibited. The use of WEB SOLutionS servers as a mail drop for responses to activities described above is also prohibited. Accounts cancelled due to spam will be billed a "clean up" fee of RM500.
- If account holders have any complaints or comments regarding Spam on our network, please direct them to our Support Desk.
CGI Scripts Policy
- Any use which interferes with the server's ability to function in its primary purpose of publishing web documents is prohibited.
- Account holders are allowed to use their own scripts in their own cgi-bin. However we reserve the right to disable any CGI script that effects normal server operation or service to other WEB SOLutionS account holders. Account holders will be notified in 24 hours about offending cgi script.
- No chat room or similar scripts are allowed other than those provided for in the Control Panel. For now, the following scripts are prohibited as they are known to be either prone to high security risk or are known to hog server resources:-
- UltimateBBS (all versions)
- Ikonboard (all versions)
- IRC Egg Drops
- Proxy Servers
- nph-proxy
- The Anonymizer
- any soap mailers
- formmail.plTraffic Policy
- WEB SOLutionS allows for very generous traffic, and most sites never exceed 1000MB per month, unless they offer shareware, sound, video, image and multimedia archives, are mirror sites or any site whose primary purpose is file distribution. WEB SOLutionS account holders are discouraged from storing any files that cause excessive traffic on WEB SOLutionS servers. Please contact our Support Desk for more information.
- We reserve the right to refuse service to anyone for any reason not prohibited by law. Also we reserve the right to terminate service to any customer for any reason not prohibited by law.
- Any deliberate attempt to cause damage to WEB SOLutionS or any other Internet servers will result in immediate account deactivation without prior notice. No refund is given in this case.
- All account plans come with a predetermined amount of traffic allowance. We monitor all accounts and accounts which exceed your traffic allocation will be suspended until you upgrade to the next plan or re-negiotiate your hosting arrangement with us, or when a new month starts.
- Should the account holder become the target of a network attack, WEB SOLutionS reserves the right to take any necessary actions (including, but not limited to, temporary suspension of the account holder's account) required to return server or network operation to normal.
Backups
- Full backups are made nightly. No guarantees are made of any kind, either expressed or implied, as to the integrity of these backups. Backups are made for server restoration purposes only. It is the account holder's responsibility to maintain local copies of their web content.
- The "Backup Manager" is included in each hosting plan and account holders can use this tool to back up their files and databases. If loss of data occurs due to an error of WEB SOLutionS, we will attempt to recover the data at no charge to the account holder. If data loss occurs due to negligence of account holder, WEB SOLutionS will attempt to recover the data from the most recent archive for a RM300.00 fee.
Support
- WEB SOLutionS provide 24/7 support via our Support Desk and Webmaster's Forum on matters relating to the efficient operation of our servers and connection to the Internet. In the event where the network connection fault is outside of our responsibilities, we will work with those involved to get it up and running as soon as possible.
- While we will go that extra mile to assist our account holders in areas which they need help, it is the account holder's responsibility to have a good working knowledge of their site's operation. WEB SOLutionS support staff is not expected to teach you how to use aspects of tools and scripts at your disposal.
- Having said that, if you are not clear on certain areas or functions, you can get help at the Support Desk or you can post such questions to the Webmaster's Forum and interact with other WEB SOLutionS members for help etc.
PAYMENT POLICIES, FEES & REFUNDS
- WEB SOLutionS provide 30 days money back, no questions asked, policy for yearly accounts.
- Full payment is required before any hosting service is rendered, which includes renewals. Prepayment is due each anniversary (one month or one year) following the date the account was established. Billing will continue until the account holder cancel their hosting account. Accounts may cancel at anytime. As a policy, we do not offer credits or refunds for hosting time already expended.
- We do give refunds for full months unused, should account holders want to cancel annual prepaid service. If accounts are cancelled after prepayment, no refund will be given for the current month in use (we do not give partial months refunds). Upon cancellation and if account holders have prepaid and received a multi-month discount, the amount to be refunded will be computed retroactively withdrawing the discount back to the start date of the contract. This will result in paying full price for the months used and refunding the balance.
- This only applies to cancellation by the account holder. If cancellation is done by WEB SOLutionS due to a violation of our TOS, there will be no refund. WEB SOLutionS will only allow for the discount if cancellation is not the fault of the account holder, as determined by WEB SOLutionS. All monetary transactions are in RM (Ringgit Malaysia). Additional features can be added at any time. Monthly feature prices are not prorated. WEB SOLutionS reserves the right to change prices at any time.
Account Cancellation
- Accounts may be cancelled anytime. To cancel an account, please contact the Support Desk. Account holders must forward their initial welcome email as confirmation of their identity.
- Notification of cancellation must be received at least five business days prior to cycle date, with the cycle date being the day of the month of sign up, in order to avoid charges in full for the next cycle. It is the account holder's responsibility to secure email confirmation from WEB SOLutionS that account has been cancelled. If the account holder has not yet received email confirmation of account cancellation, then the account remains active, and they will continue to be charged.
- If an account holder has a balance due at the time of cancellation, this balance must be paid in full. Cancellation does not absolve Client of any outstanding financial obligations.
INDEMNIFICATION POLICY
- Use of WEB SOLutionS services, including the storage of information, is at the account holder's sole risk. WEB SOLutionS does not warrant either the results to be obtained from the service or that the service will be uninterrupted or error free. WEB SOLutionS's services are provided on an "as is" basis without warranties of any kind, either express or implied. Neither WEB SOLutionS nor anyone else involved in creating, producing, or delivering WEB SOLutionS services shall be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of WEB SOLutionS, the inability to use WEB SOLutionS, or any breach of any warranty. The provisions of this paragraph will survive termination of this agreement.
- The account holder will indemnify and hold harmless WEB SOLutionS against any loss, damage, cost and expense which WEB SOLutionS may incur or become liable for by reason of claims or actions for libel, violation of privacy rights, plagiarism, copyright infringement, trademark or trade name infringement, domain name disputes, and claims arising in connection with data transmitted pursuant to the terms and provisions of this agreement and any claims or suits resulting from the account holder's use of the service including, without limitation, the expense and cost of defending any and all such claims and actions, except where such claims result solely from the negligence of WEB SOLutionS's failure to perform its obligations under this agreement. The provisions of this paragraph shall survive termination of this agreement.
- If WEB SOLutionS is informed of an alleged copyright or trademark infringement involving an account, WEB SOLutionS will attempt to notify the account holder of those allegations and secure a response. WEB SOLutionS may, in its sole discretion, remove or terminate the account containing, on a temporary or permanent basis, materials which WEB SOLutionS believes may create, constitute, or contribute to copyright or trademark infringements. Account holder expressly waives the right to assert any claims against WEB SOLutionS for any such removal or termination. The provisions of this paragraph will survive termination of this agreement.
PRIVACY POLICIES
- WEB SOLutionS will use its best efforts to maintain, but does not guarantee, the privacy of email, network use, and the contents of user directories.
- Privacy for our account holders is extremely important to WEB SOLutionS. We strongly believe in individual's rights to privacy and that personal information is not a commodity and should not be treated as one. At all times we will never share your personal information with any third parties without your permission.
- Your email addresses are not for sale or trade and are strictly guarded. Our Acceptable Usage Policy prohibits our account holders from sending unsolicited bulk commercial email (aka "spam") using our services. If it is brought to our attention that one of our account holder is violating this policy, we take steps to stop them and ensure it doesn't happen again. We also do everything within our power to keep non-account holders from using our SMTP servers for spam.
- All account holder's information such as email, etc is used only for internal purposes. This contact information is used to get in touch with you when necessary and for announcements.
MODIFICATIONS
WEB SOLutionS reserves the right to add, delete, or modify any provision of this Policy at any time. While we will make all efforts to inform all account holders via e-mails when there is a change, account holders are advised to check this TOS often to keep informed.
